A speeding ticket in Ontario can increase your insurance rates by approximately 20-50% for 3 years. Some companies may forgive a first minor conviction; however, each company is different, and you should confirm with them directly. Oftentimes, insurance companies will not know about a ticket until it is time to renew your policy. We recommend contacting the insurance company to determine the increase in price.

Contrary to popular belief, officers do not need to show you a radar at the roadside. There are a few different pieces of equipment they could be using when issuing speeding tickets in Ontario. This may include a radar mounted in the car. It is also a possibility that your vehicle was paced by the officer and there is no radar reading to show how fast you were Speeding. These interactions with officers at the roadside are typically kept short for safety reasons and may be why the officer does not show you the reading obtained. Automated Speeding Tickets in Ontario

Automated speeding tickets in Ontario do not affect your driver’s licence or insurance premiums, as they cannot prove who was driving the vehicle. The registered owner of the vehicle will receive the ticket in the mail. You have options to pay the fine or dispute the charge. Failure to choose an option with the court may result in the court sending the fine to collections with increased fine penalties. You will also not be able to renew your plate the following year. 

Speeding Tickets Ontario Options

Option #1

Plead Guilty – We do not advise selecting this option for any traffic charge. By selecting this option, you are pleading guilty to the charge. As a result, you will pay the full amount of the fine plus court costs, you will receive any/all demerit points and/or drivers licence suspension associated with the speeding ticket. The Speeding conviction will remain on your driving record for three years and your insurance may significantly increase.

Option #2

Early Resolution, Meeting with the Prosecutor – We do not suggest choosing this option as you are essentially still pleading guilty but with the possibility of a lesser offence or fine amount. This option saves the court and officer from having to proceed with another trial. A prosecutor may reduce the Speeding charge, however that is still a Speeding conviction that will appear on your driving record causing your insurance premiums to increase for 3 years. Demerit points and suspensions may still apply to reduced Speeding offers. 

Option #3

Trial – We always recommend option three for your Speeding ticket. This is the best way to maintain your clean driving record and low insurance rates. 

You have approximately 15 days to select an option with the court. It is always best to contact a legal professional as soon as you receive a ticket. This ensures enough time to request a trial, order disclosure/evidence, conduct a pre-trial and attend any court meetings on your behalf. In most cases, you would not need to attend court yourself unless your representative felt it would benefit the case for you to be present. 

  • 16-29km/h over the posted speed limit carries 3 demerit points
  • 30-49km/h over the posted speed limit carries 4 demerit points
  • 50+ km/h over the posted speed limit carries 6 demerit points.

Speeding Ticket Demerit Points

A speeding ticket can carry up to 6 demerit points against your driving record. The amount of points you receive is dependent on how many kilometers over the limit your vehicle was travelling. Please see the breakdown below:

• 0-15 km/h over: 0 demerit points
• 16-29 km/h over: 3 demerit points
• 30-49 km/h over: 4 demerit points
• over 50 km/h: 6 demerit points + a licence suspension. In addition to a speeding ticket, you may also be facing a stunt driving charge, which also carries 6 points. (12 points in total!

Demerit points will stay on your record for 2 years from the date the charge was given.

All speeding convictions, even if they do not carry any points, will stay on your driving record for 3 years from the conviction date.
